Dissecting the Agenda: November 20, 2024

This agenda raises significant concerns, not only for what is included but also for what has been glaringly omitted. Missing entirely are crucial items from the October 16, 2024, meeting, including two resolutions related to the Right to Farm Act and the Texas Agriculture Code, as well as the censure of Beth Jones. These omissions are alarming and demand further scrutiny, which we will address in a separate analysis.


Under New Business, Agenda Item 8(c) is particularly troubling. This item appears to undermine fundamental rights guaranteed to the public. The right to speak and comment at any public meeting is enshrined in Article I, Section 27 of the Texas Constitution, and further clarified in the Open Meetings Act (Chapter 551 of the Government Code).


The Legal Framework Protecting Public Comment

Section 551.007 of the Government Code explicitly authorizes governmental bodies to adopt reasonable rules regarding public comment. These rules may:


  • Limit the total time a member of the public may speak on a given topic.


However, these rules must not unfairly discriminate against any speaker based on their point of view. Moreover, and most critically, Section 551.007 provides that a governmental body cannot prohibit public criticism of its policies, actions, or decisions—unless such criticism violates other laws (e.g., threats or abusive language).


The Implications of Agenda Item 8(c)

If the intent behind Agenda Item 8(c) is to stifle dissent or control criticism, it represents a direct affront to these constitutional and legal protections. Public criticism—whether of a governmental act, policy, omission, or procedure—is a fundamental component of accountability and transparency. These rights are not negotiable and cannot be eroded by a thin-skinned or defensive governing body.


The Call for Vigilance

Any attempt to curtail public participation or limit critical discourse signals a broader disregard for transparency and the public’s role in governance. Citizens have both a right and a duty to ensure their voices are heard and their elected officials remain accountable.
